This House of Kajaana, Inc Privacy Policy (“Privacy Policy”) describes how House of Kajaana, Inc (referred to in this Privacy Policy as “Company”, “we”, “us” and “our”) collects, uses, shares, and retains information that you provide to us, or that we collect, when you use Company’s website located at www.houseofkajaana.com (the “Site”) or purchase any products that we offer through the Site (the “Products”).
BY VISITING THE SITE, PURCHASING PRODUCTS THROUGH THE SITE, AND/OR AFFIRMATIVELY ACKNOWLEDGING YOUR AGREEMENT TO THIS PRIVACY POLICY, YOU ARE AGREEING TO THIS PRIVACY POLICY.
2. INFORMATION WE COLLECT FROM YOU THROUGH THE SITE
Our collection of information depends on how you interact with us, which may be through our websites, social media pages, advertisements and other practices. Some of the information we collect includes personal information that can be used to identify you (“Personal Information”).
A. Information You Voluntarily Provide through the Site. We collect Personal Information you voluntarily provide to us when you use our Site. If you contact us with a request for information about the Site, or the Products we offer, we collect your first and last name and email address. If you place an order for Products through the Site, we may collect and store any Personal Information that you enter or provide to us when you place the order. The Personal Information we collect may include, without limitation, your name, mailing address, telephone number, email address, and financial information (e.g., your credit card number).
B. Information Automatically Collected Through the Site. We may automatically collect information about you when you use the Site. For example, if you access the Site through a computer, we will automatically collect information such as your browser type and version, IP address, computer and connection information and standard web log information. If you access the Site through a mobile device, we may also be able to identify the location of your mobile device. You may choose not to share your location details with us by adjusting your mobile device’s location services settings. 2. INFORMATION COLLECTED BY THIRD PARTIES THROUGH THE SITE
A. Information Collected by Third Parties through Third Party Links and Content. The Site may include links to other websites and other content from third party businesses. These third party businesses may use cookies, web beacons or other similar technology to collect information about you. Company does not have access to or control over these third parties or the cookies, web beacons or other technology that these third parties may use. We are not responsible for the privacy practices of these third parties or the content on any third party website. You are encouraged to review the privacy policies of the different websites you visit and of the advertisers whose ads you may choose to click while on our Site (also please see Section 3.5 below for additional information about Online Advertising).
B. Payment Processors. All credit or debit card information you provide is processed directly by our third-party payment processor. We not directly access, handle, or store your credit or debit card information. To perform a transaction, you may need to provide your card type, card number, expiration date, security code, and billing address. All credit or debit card transactions are subject to the approval of the card issuer. We will maintain a record of your transactions with us and your purchase information may be matched with other information you provide to us.
3. COOKIES AND OTHER TRACKING TECHNOLOGIES
A. Our Use of Cookies. A cookie is a small text file that is stored in your web browser that allows us or a third party use a unique identifier to recognize you. First-party cookies are set by us. Third party cookies are set by companies other than Company, such as analytics providers and advertisers. To learn more about cookies, please visit http://www.allaboutcookies.org/. When you visit the Site, we may assign your computer one or more first party cookies to facilitate access to the Site and to personalize your online experience. Through the use of a cookie, we may also automatically collect information about your online activity on the Site. The cookies that we use on the Site may be “session” cookies that are erased when you leave the Site or may be “persistent” cookies that remain on your computer’s hard drive after you leave the Site and may track you over time and across third-party websites. The Site may also use both cookies that we implement and cookies implemented by our suppliers and other third parties. We use cookies to improve the Site, customize your user experience, speed up searches, recognize when you return to the Site, analytics, and advertising purposes. If required by applicable law, we will obtain your affirmative consent before placing cookies on your web browser.
B. Changing Your Cookie Preferences. Most browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies. C. Other Tracking Technologies. We may use technologies that resemble cookies to help track user activities and preferences. For example, we may use web beacons (tiny graphics with a unique identifier embedded on web pages or emails) to track your activities and communicate with cookies. You cannot opt out of web beacons used on webpages, but you can limit their use by opting out of the cookies they interact with. You can opt out of web beacons used in emails by setting your email client to render emails in text mode only.
D. Analytics Providers. We may use Google Analytics, analytics tools provided by Google Inc. (“Google”) on the Site. Google Analytics uses cookies to analyze your use of the Site. Information collected by Google Analytics is transmitted to, and stored by, Google in accordance with its privacy practices. Google uses the information collected through Google Analytics to evaluate your use of the Site on our behalf, to create reports for us about activity on the Site and to provide us with other services related to the Site. For more information about how to opt out of having your information used by Google Analytics, follow the instructions to download and install the Google Analytics Opt-out Browser Add-On for each web browser you use. Using the Google Analytics Opt-out Browser Add-On will not prevent us from using other analytics tools and will not prevent data from being sent to the Site itself or to Google.
E. Online Advertising and Tracking. Company and third party businesses may use the information collected through the Site using cookies to help manage online advertising programs. This information may enable us, as well as third party advertising services and other third party businesses to track the actions of users online over time and across different websites or platforms to measure statistics relating to marketing efforts, and to deliver electronic advertisements that may be more relevant to individual consumers and that will improve the consumer experience. F. Do Not Track. Your browser may allow you to adjust your browser settings so that “do not track” requests are sent to the websites that you visit. However, we do not currently disable tracking technology that may be active on the Site in response to any “do not track” requests that we receive from your browser.
3. HOW WE USE YOUR INFORMATION
A. Fulfillment of Orders and Requests. If you provide your information to us for a particular purpose we will use the information you provide for the applicable purpose, for example, if you place an order for Products through the Site, we will use the information you provide so that we can fulfill your order, or if you provide us with your email address so that we can provide email communications to you, we will use the information you provide for purposes of sending you those email communications.
B. Operation of the Site. We may use the Personal Information we collect in connection with the Site to operate and offer the Site to you, including for purposes of ensuring technical functionality, creating and managing your user account, and otherwise to provide and optimize the Site. We may also use the information we gather through the Site to help us better understand how the Site and our services are being used. By identifying patterns and trends in usage, we are able to better design the Site to improve your experience.
C. Direct Marketing Communications. If you sign up for our mailing list, we will use the Personal Information and other information you provide to send you email marketing communications relating to the Site. If you no longer wish to receive these marketing communications, please follow the instructions contained in the applicable marketing communication that allows you to unsubscribe from receiving these types of marketing communications.
D. Profiling. We may use the Personal Information you provide in connection with the Site to help augment your user experience of the Site. Collecting and analyzing information regarding your use of the Site helps us provide you with information, content and advertisements that may be of interest to you.
E. To Combat Misuse of the Site. We may use your Personal Information to protect the Site and your rights, and the rights of others, to enforce the terms and conditions applicable to Site, and to prevent prohibited or illegal activities.
5. HOW WE SHARE YOUR INFORMATION. We will not provide, sell or rent user information we collect through the Site to any third parties for their own marketing purposes unless you affirmatively opt in to permitting third parties to use your information for their own marketing purposes. We do share your Personal Information and other information with third parties in some circumstances as follows:
A. Third Party Processors and Third Party Service Providers. Company may employ or engage other companies to perform business functions on behalf of Company (“Service Providers”), such as operating and supporting the Site, analyzing data, or performing marketing or consulting services. These Service Providers will only have access to the information needed to perform these limited functions on our behalf but are prohibited from using the information for other purposes, except as permitted by law or upon your consent.
B. Response to Subpoenas or Court Orders or to Protect Rights and to Comply with Our Policies. To the extent permitted by law, we will disclose your information to government authorities or third parties if: (i) required to do so by law, or in response to a subpoena or court order; (ii) we believe in our sole discretion that disclosure is reasonably necessary to protect against fraud, to protect the property or other rights of us or other users, third parties or the public at large; or (iii) we believe that you have abused the Site by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws. You should be aware that, following disclosure to any third party, your information may be accessible by others to the extent permitted or required by applicable law.
C. Business Transfers; Bankruptcy. In the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets, any user information owned or controlled by us may be one of the assets transferred to third parties. We reserve the right, as part of this type of transaction, to transfer or assign your information and other information we have collected from users of the Site to third parties. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Privacy Policy. However, any information you submit or that is collected after this type of transfer may be subject to a new Privacy Policy adopted by the successor entity.

6. SECURITY OF PERSONAL DATA. The security of your Personal Information is important to us. We do not guarantee that loss, misuse, or alteration of information we collect will not occur, but we have reasonable security measures in place to help protect against the loss, misuse, and alteration of information under our control. 7. TRANSFERRING PERSONAL DATA TO THE U.S. Company has its headquarters in the United States. The Personal Information we collect from you will be processed in the United States. The standards and laws that apply to the protection of Personal Information in the United States may be different than the ones that are applicable to the country where you are located.
8. CHILDREN. The Site is not directed to children under the age of 13. We will not knowingly collect Personal Information from any child under the age of 13, unless a parent or guardian consents to our collection and processing of this information. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at hello@houseofkajaana.com.
9. DATA RETENTION. We will only retain your information for as long as necessary to fulfill the purposes for which we collected the information, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements. When determining the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your information and whether we can achieve those purposes through other means, and the applicable legal requirements.
10. SPECIAL INFORMATION FOR CALIFORNIA RESIDENTS
A. If you are a California resident under the age of 18 and are a registered user of the Site, you may request that we remove content or information that you uploaded to the Site or stored on our servers by (i) submitting a request in writing to hello@houseofkajaana.com and (ii) clearly identifying the content or information you wish to have removed and providing sufficient information to allow us to locate the content or information to be removed. However, please note that we are not required to erase or otherwise eliminate content or information if (a) other state or federal laws require us or a third party to maintain the content or information; (b) the content or information was posed, stored, or republished by another user; (c) the content or information is anonymized so that the minor cannot be individually identified; (d) the minor does not follow the instructions posted in this Privacy Policy on how to request removal of such content or information; and (e) the minor has received compensation or other consideration for providing the content. Further, nothing in this provision shall be construed to limit the authority of a law enforcement agency to obtain such content or information.
B. California Civil Code Section 1798.83 permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the preceding calendar year, as well as the categories of personal information disclosed to those third parties. 11. SPECIAL INFORMATION FOR NEVADA RESIDENTS. If you are a Nevada resident, under Nevada law, you may request that we refrain from sale of your Personal Information to an entity, for the entity to further sell the information to additional organizations or persons. We do not sell your personal information pursuant to Nevada law. If you have a question, concern, or request with respect to your Personal Information under Nevada law, please contact us at hello@houseofkajaana.com for more information or to exercise your rights. We will reply to any request within sixty (60) days of receipt. We may extend this request for not more than thirty (30) days if we determine the extension is reasonably necessary, and in which case we will notify you of our intent to invoke the extension.
12. UPDATES TO THIS PRIVACY POLICY. We may change, modify or amend this Privacy Policy from time to time. We will notify you of material changes to this Privacy Policy by posting the amended terms on the Site reasonably in advance of the effective date of the changes. If you do not agree with the proposed changes, you should discontinue your use of the Site prior to the time the new Privacy Policy takes effect. If you continue using the Site after the new Privacy Policy takes effect, you will be bound by the modified Privacy Policy.

In addition, if you are a registered member, you can review and update your Personal Information by logging into your account and modifying or deleting the applicable information.
